Can Swiss Companies Apply?

Yes. Although Switzerland is not in the EU, Swiss companies and individuals can apply for an EUTM. The only requirement is to appoint a legal representative with a registered address in the EU — typically a trademark attorney or law firm. How Does the Process Work?

Registering a European trademark starts with a search to confirm that your brand (name, logo, or slogan) is available and not already protected. You’ll also need to classify your trademark under the correct categories of goods and services (known as the Nice Classification).
Once submitted via EUIPO, the application is reviewed for formal issues and published in the EU Trademark Bulletin. If no oppositions are filed within three months, the trademark is registered.
The process typically takes 4–6 months if uncontested. Your EUTM is valid for 10 years and can be renewed indefinitely.

What Are the Costs?

The base fee is €850 for one class, plus €50 for a second class and €150 for each additional class. Compared to filing trademarks separately in each country, this offers significant cost savings and administrative simplicity.

Swiss Trademark Priority

If you already own a trademark in Switzerland, you may be able to claim priority when registering in the EU — meaning the filing date of your Swiss registration will apply to your EU trademark as well. This can only be done within six months of your Swiss filing date.
